Hôm nay, 20/02/2013, một cố vấn của tổng thống Aquino, ông Rene Almendras tuyên bố là Philippines "hành động đúng" khi kiện Trung Quốc ra trước toà án quốc tế về bản đồ "đường lưỡi bò" áp đặt chủ quyền trên toàn bộ Biển Đông. Ông Almendras tuyên bố như trên sau khi hôm qua Bắc Kinh đã chính thức bác bỏ yêu cầu của Manila đưa tranh chấp này ra trước Tòa án Liên Hiệp Quốc. 
 
Theo lời cố vấn của tổng thống Aquino, chính phủ Manila đã dự trù là Bắc Kinh sẽ bác bỏ yêu cầu của Philippines, nhưng ông nhấn mạnh là Manila sẽ tiếp tục vụ kiện cho dù Trung Quốc có chấp thuận hay không.

Vào tháng trước, Philippines thông báo đã đưa vấn đề tranh chấp chủ quyền Biển Đông với Trung Quốc ra trước tòa án trọng tài của Liên Hiệp Quốc, chiếu theo Công ước Liên Hiệp Quốc về Luật Biển năm 1982, mà cả hai nước đều ký kết. Manila muốn tòa án Liên Hiệp Quốc tuyên bố bản đồ « đường lưỡi bò » của Trung Quốc là « phi pháp ».

Nhưng Trung Quốc cho tới nay vẫn khẳng định chủ quyền « không thể tranh cãi » trên gần như toàn bộ vùng Biển Đông, kể cả những vùng nằm sát bờ biển của Philipines, cũng như của Việt Nam.

Hôm qua, Trung Quốc đã chính thức bác bỏ yêu cầu của Philippines đưa vấn đề tranh chấp chủ quyền Biển Đông ra trước tòa án trọng tài Liên Hiệp Quốc, nhấn mạnh rằng hai nước nên thương lượng song phương về vấn đề này.

Chiếu theo các quy định của Công ước Liên Hiệp Quốc về Luật Biển, tòa án trọng tài có thể phân xử cho dù Trung Quốc không chịu tham gia.

Bắc Kinh chắc chắn là sẽ không chấp nhận bất cứ phán quyết nào của tòa án. Nhưng nếu Liên Hiệp Quốc ra phán quyết cho rằng bản đồ « đường lưỡi bò » là phi pháp, thì đây sẽ là một vố đau về mặt ngoại giao đối với Trung Quốc.
